PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE AGREEING & SUBMITTING YOUR INFORMATION TO HAPPY PLUGS.
Happy Plugs would like to promote and share your content in conjunction with the promotion of our brand and products. By agreeing to these terms and conditions, you confirm that you are willing to collaborate in return for no monetary compensation.
By distributing, posting, sending or displaying any comment, photos, graphics, or any other content (the “User Generated Content”), posted with the hashtag #HappyPlugs, #WhatColorAreYouToday, #HappyPlugsMoment or tagged with the @HappyPlugs account, you grant Happy Plugs and a royalty-free, perpetual, irrevocable, worldwide license to edit and use your content for all marketing and advertising purposes, including but not limited to: Instagram, Facebook, Twitter, Snapchat, LinkedIn, Pinterest, YouTube, Line, Weibo, WeChat, TikTok and on www.happyplugs.com and in other online or offline media, including without limitation, on the website gallery, in newsletters, catalogs, email, other customer communications and marketing purposes.
Happy Plugs reserves the right to use the User Generated Content as it deems appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. Happy Plugs is under no obligation to offer you any payment for User Generated Content or to attribute authorship of User Generated Content to you.
You further grant Happy Plugs the right to pursue at law any person or entity that violates your or Happy Plugs’ rights in the User Generated Content by a breach of these Conditions. User Generated Content submitted by users is deemed non-confidential and Happy Plugs is under no obligation to treat such User Generated Content as proprietary information.
This license can also be transferred by Happy Plugs and its affiliated companies to third party collaborators for the purpose of promoting products under the Happy Plugs brand. This license also includes a right, but not an obligation, to refer to the creator of the User Generated Content and the social media account where the User Generated Content was uploaded.
You confirm that you own or control the rights to the User Generated Content. If you are under 18 years old you guarantee that you have your parents consent. You hereby release and discharge Happy Plugs from all and any obligation to pay you for any use of your User Generated Content and any of the intellectual property rights contained therein in connection with the uses described above; and You hereby release, discharge and agree to hold Happy Plugs and any person acting on Happy Plugs’ behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of the User Generated Content as described above. Furthermore, you certify that the User Generated Content submitted by you does not violate any rights of a third party or any law.
SOCIAL MEDIA PRIVACY POLICY
By working with the Happy Plugs’ Social Media team, you willingly submit your information, such as email address, social media account name and shipping address to Happy Plugs. We process the collected information only for the purpose of administering and maintaining the collaboration relationship.
You have the right to request access to the personal data that we store about you. You also have the right to request that incorrect or incomplete personal data is corrected. Furthermore, you have the right, to the extent our processing is based on your consent, to at any time revoke your consent to our processing of your personal data. As of 25 May 2018, EU residents and citizens have, to the extent applicable data protection laws provide, a right to erasure of personal data, restriction of processing, to object to certain processing and a right to data portability.
The right to data portability covers such personal data that you have provided to us and which we process either based on your consent or in order to fulfill our contractual obligations in relation to you. This typically includes your name, e-mail address and address.
